Matthew Kanyamunyu, who is suspected of having murdered Kenneth Akena last year has today been granted bail by the High Court.
He has been in Luzira since November last year.
Kanyamunyu who is accused of shooting Kenneth Akena at Lugogo last year was denied bail three times by the same that released his co-accused Cynthia Munwangari and Joseph Kanyamunyu.
However, Justice Wilson Kwesiga said court could not keep Kanyamunyu in detention yet his case has not been scheduled to be heard now.
"Staying in detention has a financial implication on government yet prisons have many inmates more than their capacity, "the judge said.
He said that if the current practice is to go by, courts dispose off the oldest cases first, adding that Kanyamunyu's case will not be heard in the near future if the practice is followed.
"The court is now trying cases of 2013 yet his was committed on 31, January ,2017 which means it will be tried later."
Justice Kwesiga also downplayed the argument by the state that Kanyamunyu doesn't have a fixed place of abode and therefore cannot be released on bail.
He argued that the fact that he has a place he rents and stays is enough to show that he can be granted bail because its in the court's jurisdiction.
Court also ruled that the five sureties presented were substantial to enable Kanyamunyu be released on bail.
"In exercising my discretion, I grant him bail."
The judge however asked Kanyamunyu to deposit his passport with the court and also executive a Shs 10 million cash bond before being released.
Each of the five sureties were also asked to part with 10 million non cash as bond.
Prosecution alleges that the accused and others still at large on November 12, 2016 along Kampala-Jinja road opposite Malik car bond with malice aforethought caused the death of Akena, a community development officer, employed by a local non-governmental organisation.
Kanyamunyu reportedly shot Akena, 33, in the stomach over the denting of his car.
Akena died a day after at Norvik Hospital, on Bombo Road in Kampala.
